Terms of Service

Agreement to Terms

By downloading, installing, or using MyVisualRoutine ("the App"), you agree to be bound by these Terms of Service. If you downloaded the App from the Apple App Store, Apple's Standard EULA also applies. If you do not agree to these terms, do not use the App.

Description of Service

MyVisualRoutine is a mobile application that helps parents, caregivers, and families create and use visual schedules, choice boards, and First/Then boards to support daily routines and communication.

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, non-commercial purposes

The App is licensed, not sold, to you. This license does not grant you any ownership interest in the App. The App may only be obtained through authorized distribution channels (Apple App Store and Google Play Store). Obtaining the App through any other means is unauthorized and may result in a version that is modified, outdated, or harmful. We are not responsible for any issues arising from copies obtained outside of official stores.

Account and Registration

MyVisualRoutine does not require account registration. The App operates on a device-based model where:

• No email, password, or personal information is required
• All data is stored locally on your device
• Your "identity" within the App is tied to your device

Subscriptions and Payments

Free and Premium Tiers

MyVisualRoutine offers both free and premium tiers. The free tier includes limited features, while the premium subscription unlocks additional functionality. Current features, limitations, and pricing are displayed within the App and may change from time to time.

Free Trial

New users may receive a free trial period with access to premium features. Trial duration and terms are displayed in the App. After the trial ends, you may subscribe to continue premium access or use the free tier.

Billing

• All payments are processed by the platform through which you downloaded the App (Apple App Store or Google Play Store)
• Subscriptions automatically renew unless cancelled
• Prices may vary by region and are shown in local currency

Cancellation

• Cancel anytime through your device's subscription settings (Apple ID settings on iOS, Google Play subscriptions on Android)
• Access continues until the end of the current billing period
• No partial refunds for unused time

Refunds

Refund requests must be made through the platform where you purchased the subscription:

• Apple: Apple Support - Request a Refund
• Google Play: Google Play - Request a Refund
• We cannot process refunds directly

Device Compatibility

The App is designed for specific operating system versions and device types. We do not guarantee that the App will function on all devices or operating system versions. Due to the variety of hardware, software, and device configurations available (particularly on Android), you acknowledge that:

• The App may not be compatible with your device
• Performance may vary between devices and operating system versions
• Features may behave differently across platforms and devices
• We are not liable for any issues caused by device-specific behavior, manufacturer modifications to the operating system, or unsupported configurations

Maintenance and Support

We may, at our sole discretion, provide updates, bug fixes, or support for the App. We are under no obligation to provide maintenance, technical support, or updates. Any support provided is governed by these Terms. The distribution platforms (Apple and Google) have no obligation to provide any maintenance or support services for the App.

User Content

Your Content

You retain ownership of all content you create within the App, including:

• Routines, choice boards, and First/Then boards
• Custom images you capture or select
• Voice recordings
• Profile information

Content Responsibility

You are solely responsible for:

• The appropriateness of content you create
• Ensuring content does not violate others' rights
• Backing up content you wish to preserve

Content Storage

All user content is stored locally on your device. We do not:

• Access your content
• Store your content on our servers
• Back up your content

If you delete the App, all content is permanently deleted.

Acceptable Use

You agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Use the App for any commercial purpose without permission
• Remove any copyright or proprietary notices
• Use the App to violate any laws or regulations
• Attempt to gain unauthorized access to the App's systems
• Distribute, license, or sell the App to third parties

Intellectual Property

Our Property

MyVisualRoutine, including all content, features, and functionality (excluding user content), is owned by Torstein Skulbru and protected by copyright, trademark, and other intellectual property laws.

This includes:

• App design and interface
• Preloaded activity icons and images
• Brand name and logos
• Documentation and marketing materials

Preloaded Content

The 50+ preloaded activities and their associated icons are licensed for use within the App only. You may not:

• Extract icons for use outside the App
• Redistribute preloaded content
• Claim ownership of preloaded content

Medical Disclaimer

Privacy

Your privacy is important to us. Please review our Privacy Policy for information about how we handle (or rather, don't handle) your data.

Key points:

• No personal data collection
• All content stored locally
• No tracking or analytics in the App

Third-Party Platforms

You acknowledge and agree that:

• These Terms are between you and Torstein Skulbru (the developer), not with Apple, Google, or any other platform provider
• The developer, not the platform provider, is solely responsible for the App and its content
• The platform providers have no obligation to provide maintenance, support, or warranty services for the App
• In the event of any failure of the App to conform to any applicable warranty, the platform provider's maximum liability is limited to refunding the purchase price (if any) of the App, and the developer is solely responsible for any other claims, losses, or damages
• The platform providers are not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims
• The platform providers are third-party beneficiaries of these Terms and may enforce them against you

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will meet your specific requirements
• The App will be compatible with your device, operating system, or other software
• The App will be uninterrupted, timely, secure, or error-free
• Results from using the App will be accurate or reliable
• Any errors will be corrected
• The App will function identically across all platforms and devices

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, or goodwill
• Service interruption or inability to use the App
• Issues arising from device-specific behavior, operating system updates, or incompatibilities
• Data loss resulting from device malfunction, operating system changes, app deletion, or any other cause
• Any other intangible losses

This applies whether based on warranty, contract, tort, or any other legal theory.

Our total liability for any claims shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $50 USD, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Torstein Skulbru (the developer of MyVisualRoutine) from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create within the App

Changes to the App

We reserve the right to:

• Modify or discontinue features
• Update pricing for new subscriptions
• Change these Terms with reasonable notice

Continued use after changes constitutes acceptance.

Termination

We may terminate or suspend your access to the App:

• For violation of these Terms
• For conduct we deem harmful to other users or us
• At our sole discretion with or without notice

Upon termination:

• Your license to use the App ends
• You must delete all copies of the App
• Provisions that should survive (like Limitation of Liability) remain in effect

Legal Compliance

You represent and warrant that you are not located in a country that is subject to a government embargo or that has been designated as a "terrorist supporting" country, and that you are not listed on any government list of prohibited or restricted parties. You agree to comply with all applicable local, national, and international laws and regulations in connection with your use of the App.

Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

Dispute Resolution

If you have any concerns or disputes regarding these Terms or the App, please contact us at [email protected]. We will make reasonable efforts to resolve any issues.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyVisualRoutine regarding the App.
